Terms and Conditions Agreement

The customer accepts these terms and conditions when placing an order by checking the required check box during checkout.

These terms and conditions (the "Terms and Conditions") govern the use of www.quantumhyperx.com (the "Site"). This Site is owned and operated by QuantumhyperX. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.


We accept the following payment methods on our Site:

  • Credit Card Payment Process: All transactions are final sale and consumer products are not returnable. If a product cannot be allocated at the warehouse for shipment a refund will be issued. Also note that tracking numbers are not active until products leave the UPS warehouse.
  • Shipping Address: The shipping address must be the billing address on credit card statement. Credit cards still require a valid full address AVS (Address Verification Service) before an order can be processed.           
  • Back-Order and Special Order: Requires prepayment before an order can be placed. The manufacture will generate an ETA for delivery but reserves the to modify the ETA if required. If the manufacture cannot fill their order then a refund will be generated. 
  • Credit Cards - Visa - Major Canadian Banks Excepted: TD Canada Trust, RBC - Royal Bank of Canada, BMO - Bank of Montreal and Scotia Bank - Bank of Novia Scotia (As of Oct 22, 2022, all Issuing banks and Aquirer's are required to use the 3D Secure 2.2 Protocols). Smaller credit card companies still may not offer 3D Secure for e-commerce and these transactions are presently rejected by our Payer Authentication settings for those card holder's protection and will require the card holder to use a credit card from a major bank. (Payer Authentication will also reject your transaction if the AVS is not correct. Please note a verified billing address through our AVS system is still required for us to ship your order.)
  • Verified by Visa - Version 2: This allows Visa to verify that the transaction in process is in fact the card holder placing the order. A verified card holder must then accept the responsibility for the transaction and the also shipping address based on the primary billing address supplied for the signature required delivery. Proof of delivery is stored with our records and can be retrieved for the customer if and when requested. Please contact use if the wrong item was received or if the packaging used to deliver the item was damaged. For defective protects we will assist you in contacting the manufacture if you are having issues with the included limited manufacture warranty.
  • ECI Codes - ECI Code 05 for Visa 
  • Challenge/Frictionless Authentication

  • CAVV Cryptographic Value: This cryptographic value is generated as a confirmation receipt that is sent to the issuing bank, acquirer and the merchant proving the card holder was verified in the authorizations. 
  • What is Challenge Authentication: Challenge authentication was mandated for all online transactions requiring the use of a pass code and a personal device for every transaction, for both commercial and consumer credit cards. The issuing bank also uses an AI multipoint check during authorization to further enhance a secure transaction.
  • QuantumhyperX Systems only processes Challenge Authenticated Visa transactions for consumer electronics and computers.  

When you provide us with your payment information: You authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Before placing an order review the following list.

1) Verify that products are in stock when using Interac e-Transafer, Visa Debit, MasterCard Debit or Prepaid Cards

2) ETA is supplied by the manufacture after placing an order for special order products

3) Back Order ETA not Guaranteed, products may require 4-6 weeks for delivery

4) Prices may change without notice when manufacturer pricing changes. This also may result in a price decrease if the manufacturer does

5) The manufactures reserve the right to discontinue any product that is on special order without notice 

6) We can only offer wholesale pricing if the price was not entered correctly or if the manufacture has increased the price without notice. 

7) All Products listed on this web site are considered Back Order unless otherwise specified. 

8) Products that are in stock ship the next day business day 

9) All sales are based on the manufactures part number - Confirm product information with the manufacturer 

10) Images may not be exactly as shown but every effort is made to ensure they are accurate 

11) Consumer Products Purchased Online Include a One to Three Year Warranty. Activate them with the manufacturers website. 

12) For Defective Products - Contact the manufacture for replacement.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods: Adult Signature required Courier Delivery.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Refunds for Goods
Refund requests must be made within 30 days after receipt of your goods. 

We accept refund requests for goods sold on our Site for any of the following reasons: Good is broken or Good does not match the manufacturer SKU.

Refunds do not apply to the following goods:

  • Consumer Electronics (Computer, Laptops, monitors, Computer Hardware and Software).

Refunds for Services
We provide refunds for services sold on our Site as follows:

  • No refund policy for merchant gateway services (30 day free demo is offered to test the environment)

Returns can be made by mail. To return a good by mail, follow the following procedure:

Intellectual Property
All content published and made available on our Site is the property of QuantumhyperX Systems and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Age Restrictions
The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;
  • Violate the rights of other users of our Site;
  • Violate the intellectual property rights of the Site owners or any third party to the Site;
  • Hack into the account of another user of the Site;
  • Act in any way that could be considered fraudulent; or
  • Post any material that may be deemed inappropriate or offensive.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

By posting publicly on our Site, you agree not to act illegally or violate these Terms and Conditions.

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods are available on our Site:

  • Desktops;
  • Laptops;
  • Computer Hardware;
  • Computer Software.

The following services are available on our Site:

  • Gateway Services for Merchant Accounts. The services will be paid for in full when the services are ordered.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk. We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

User Goods and Services
Our Site allows users to sell goods and services. We do not assume any responsibility for the goods and services users sell on our Site. We cannot guarantee the quality or accuracy of any goods and services sold by users on our Site. However, if we are made aware that a user is violating these Terms and Conditions, we reserve the right to suspend or prohibit the user from selling goods and services on our Site.

Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription.

Free Trial
We offer the following free trial of our goods and services: 30 Day Free Trial on Demo Gateway Services.

At the end of your free trial, the following will occur: No Purchase Obligation.

To cancel your free trial, please follow these steps: Account is closed after 30 days if the customer does not want purchase on a monthly charge.

The following guarantees apply to our Site:

  • All products sold online include a manufacture limited warranty.

Consumer Protection Law
Where the Business Practice and Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability
QuantumhyperX Systems and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Except where prohibited by law, by using this Site you indemnify and hold harmless QuantumhyperX Systems and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the Province of British Columbia.

Dispute Resolution

Visa Dispute Resolution

Please Note Verified by Visa transactions are protected from fraud related charges (Card-Absent Environment, Reason Code 10.4). Claims of fraud (reason code 10.4) require the issuer to review data from Visa to validate a case to be true or untrue before a chargeback is initiated. If an issuer pursues the case without the data being validated through Visa Net we consider this a breach of trust on behalf of the issuer and an act of chargeback fraud by the issuer and the card holder. This can typically end with the loss of the card holders credit card. 

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and QuantumhyperX Systems are unable to resolve any dispute through informal discussion, then you and QuantumhyperX Systems agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and QuantumhyperX Systems. The costs of any mediation or arbitration will be paid by the unsuccessful party.

Notwithstanding any other provision in these Terms and Conditions, you and QuantumhyperX Systems agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

HP Commercial and Home Office - Terms and Conditions.

Please note our contract with HP only allows use to sell to the "Individual" not a Company (such as a Reseller). 

HP Product also cannot be shipped outside of Canada.

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
